This data protection policy applies to use of Com4expats Website.
 
Through the Com4expats Website, ANACOM, DGC and CEC may collect personal data from users, in particular when users complete and submit electronic forms that are made available for various purposes, as indicated below.
 
This data protection policy aims to provide users with information on now their personal information is collected and processed by ANACOM, DGC and CEC, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and also in accordance with Law no. 58/2019 of 8 August.
 
Data Controller
 
Where there is collection and processing of personal data, this data is processed by ANACOM, with registered office at Rua Ramalho Ortigão, 51, 1099-099 Lisbon, NIPC 502017368, telephone 800206665 and email epd@anacom.pt. In this respect, ANACOM acts as the “data controller”.
 
Personal data that we may collect and process through the website
 
The personal data we collect is processed by ANACOM in accordance with the data protection requirements set out in the above legislation. The type of personal data collected and the purpose of its processing varies depending on the services requested or the subscriptions made by the user through the Com4expats Website:
 
  • Form submission: name and email
 
The personal data which is collected and processed by ANACOM is received directly from the data subject.
 
Purposes and lawful basis for processing
 
The personal data which we process is used solely to provide the services requested by the user and to respond to the needs of users with regard to the Com4expats Website. ANACOM collects and processes the personal data of users for one or more of the following reasons:
 
a) Because we are required to do so in compliance with our legal obligations. 
b) Because the processing of personal data is necessary for the performance of a contract. 
c) Because, in accordance with legal provisions, personal data is of particular importance to ANACOM and there is a legitimate interest in its processing. 
d) Because the data subject has given their consent to the processing of their data (in this case, consent may be withdrawn by the user at any time).
 
Purpose Lawful basis for processing
Answer to contact form in  “Talk to us”: ANACOM collects personal data to answer questions asked through this feature. The data is collected only as required to answer your questions.
Analysis of statistical data: data is collected using cookies with the aim of gathering data on user interaction and general activity on the Com4expats Website. The data obtained in this way does not allow the establishment of any relationship in terms of the user’s IP address for the purpose of verifying personal data. The processing of your personal data for this purpose occurs only when you have given your consent. For more information, please consult our cookies policy.
Disclosure of personal data with third parties
 
Within the scope of its activity, ANACOM may employ the services of third parties (service providers), such as companies that own videoconferencing platforms used for webinars and companies that provide IT services. These third parties will not process data for any purpose other than as specified by ANACOM and are prohibited from carrying out any processing that is not in accordance with ANACOM’s instructions.
 
These sub-processors are bound by contract, which requires the implementation and maintenance of appropriate data security measures in relation to all personal data that they process on ANACOM’s behalf.
 
ANACOM may also disclose some of your personal data to third parties when such disclosure is required by law.
 
Transfer of personal data
 
In circumstances where ANACOM needs to transfer personal data, this transfer will be made in compliance with the requirements laid down in applicable personal data legislation.
 
Specifically, ANACOM ensures that the transfer is carried out, in most cases, based on model contractual clauses approved by the European Commission. These clauses can be consulted at: Commission Decision of 5 February 2010 on standard contractual clauses for the transfer of personal data to processors established in third countries under Directive 95/46/EC of the European Parliament and of the Council.
 
Otherwise, ANACOM ensures that appropriate data protection measures are implemented.
 
Security
 
ANACOM takes appropriate measures to protect personal data in accordance with applicable data protection legislation, including as follows:
 
a) The personal data you provide is communicated to us over a secure connection with your Internet browser. 
b) Using the functions of your browser, click on the small padlock icon in the top left corner of the screen. You can check the information contained in the Digital Certificate that will be shown and confirm that the entity you are connected to is legitimate. Since the communication channel is encrypted, users can transfer data with a guarantee of privacy and security. 
c) All ANACOM staff involved in data processing are covered by an obligation of secrecy and confidentiality in relation to said data.
 
Retention of data
 
Except where a longer retention period is required or permitted by law, ANACOM retains personal data only for the period necessary to fulfil the purposes described in this data protection policy.
 
Criteria used to determine the retention period include: 
a) Withdrawal of consent by data subjects (when applicable). 
b) Any requirement to comply with a legal obligation to which ANACOM is subject. 
c) Determination of the period on the basis of ANACOM's legal position (for example, in relation to periods of limitation, expiry, existing administrative/judicial processes, ongoing investigations/inspections of regulatory entities).
 
Rights relating to personal data
 
a) Right to access your personal data and right to rectify it
 
ANACOM is committed to the accuracy of all personal data. Data subjects have the right, but also the responsibility, to ensure that any changes to their personal data are communicated to ANACOM in a timely manner so that we can maintain its accuracy.
 
Data subjects can also access their personal data, as well as obtain information on the following:
  • the purposes for which their personal data is being processed;
  • the type of personal data that is being processed;
  • the entities to which their personal data may have been transferred, including entities located in countries outside the European Union or international organisations, in which case you will be informed of the guarantees applied to the transfer of your data, how you can obtain a copy of these guarantees, or where these guarantees are made available;
  • the period for which their data will be retained or, if this is not possible, the criteria for establishing this period;
  • their rights in relation to the processing of their personal data;
  • if the personal data has not been collected from the data subject, information on how it was obtained and the type of data in question;
  • the existence of automated individual decisions, including profiling, and, in this case, information about the logic underlying that processing, as well as the importance and consequences of that data processing.
Data subjects are required to keep all personal data up to date and to inform ANACOM about any significant changes. Changes should be notified in writing by sending an email to epd@anacom.pt.
 
ANACOM reserves the right to suspend or cancel a user’s account in the event that the information provided is found to be false, incorrect, outdated or incomplete. ANACOM will only suspend or cancel a specific account after notifying the respective user, who will be given a period of thirty days to correct or update the information in question.
 
b) Right to erase your personal data
 
Data subjects have the right to have their personal data erased, without undue delay, when one of the following reasons applies:
  • The personal data is no longer necessary for the purpose for which it was collected or processed.
  • The data subject withdraws the consent on which the lawfulness of the data processing is based and there is no other lawful basis for its processing.
  • Their personal data has been processed unlawfully.
  • Their personal data must be erased to comply with a legal obligation to which the controller of that data is subject.
 
c) Portability of personal data
 
In cases where ANACOM processes personal data based on the consent of the data subject as the lawful basis for its processing or where ANACOM processes personal data on the basis that processing is necessary for the performance of a contract, and where this processing takes place in an automated manner, data subjects have the right to receive their personal data from ANACOM in a structured, commonly used and machine-readable format. Data Subjects may also require ANACOM to transfer their personal to another data controller when this transfer is technically feasible.
 
d) Right to restrict processing 
 
Data subjects have the right to restrict the processing of their personal data by ANACOM, in the following cases:
  • The data subject contests the accuracy of their personal data, and until such time as ANACOM has adopted sufficient measures to rectify the data or ascertain its accuracy.
  • The processing of their data is unlawful, but the data subject does not want ANACOM to erase the data.
  • ANACOM no longer requires the personal data for the purposes for which it is being processed, but it is required by the data subject for the purposes of declaring, exercising or defending a right in legal proceedings.
  • Data is being processing for reasons of legitimate interest (see below) and the data subject has objected to processing for this purpose, until such time as it can be ascertained whether ANACOM has compelling legitimate reasons to continue its processing.
  • In cases where personal data is subject to these limitations, ANACOM will only process it with the consent of the data subject or for the purposes of declaring, exercising or defending a right in legal proceedings.
e) Right to object
 
Data subjects have the right to object to the processing of their personal data at any time, for reasons related to their particular situation, in the following circumstances:
  • When data processing is based on ANACOM's legitimate interests.
  • When data processing is carried out for purposes other than those for which it was collected, but which are compatible with said purposes.
  • For direct marketing purposes, including profiling.
In these cases, ANACOM will no longer process the personal data, unless it has legitimate reasons to carry out such processing and where these reasons prevail over the interests of the data subject.
 
f) Right not to be subject to exclusively automated individual decisions
 
ANACOM will not make decisions that affect the holder of personal data based on exclusively automated processes.
 
g) Right to withdraw consent
 
In cases where ANACOM relies on consent as the lawful basis for processing, data subjects have the right to withdraw that consent at any time.
 
Withdrawal of consent does not affect the lawfulness of any processing which took place prior to the withdrawal of consent and which was based on that consent. If consent is withdrawn, processing of the personal data will cease, except where there is another lawful basis for its processing, such as the performance of a contract, legal and regulatory obligations or ANACOM's legitimate interests.
 
h) Right to complain
 
If the processing of their personal data is considered to be in breach of applicable legislation, data subjects also have the right to complain. Complaints can be made to Comissão Nacional de Proteção de Dados (National Data Protection Commission).
